1. Acceptance of Terms
By downloading, accessing, or using the inewme App (“App”), you agree to these Terms of Service (“Terms”). If you do not agree, you may not use our Services. Connectivity with inewme-branded devices is covered by these Terms only insofar as it relates to the App’s software features. Hardware warranties, instructions, and terms of use are provided separately with each device.
2. Our Services
- User registration and login (phone number, Google, Apple ID).
- Bluetooth pairing and synchronization with compatible inewme devices. App connectivity does not modify or control device safety functions; users should follow the hardware manual for safe operation.
- Skin condition analysis via camera, with optional cloud backup of analysis photos. Disabling backup stops new uploads but does not delete previously uploaded photos (unless the user deletes their account).
- Personalized hydration and skincare recommendations based on skin type, usage history, and environmental conditions.
- Daily hydration reminders, environmental change notifications, and skincare test reminders.
- Skincare product management via photo recognition and personal skincare library.
- User account management, including editing profile, deleting specific records, and permanent account deletion.
Eligibility & Age. You must be at least 13 years old to use the App. In certain jurisdictions, additional age thresholds may apply for specific features; see our Privacy Policy for details, especially regarding parental consent requirements. Our Services are not directed to children under 13.
Note: The App currently does not offer in-app purchases, subscriptions, or paid features. Any future changes will be reflected in updated Terms.
We continually improve our Services, and features may be added, modified, or removed without prior notice.
3. User Obligations
- Provide accurate registration information and maintain account security.
- Use the App only for personal, non-commercial purposes.
- Not misuse the Services, including reverse engineering, hacking, or unauthorized data extraction.
- Comply with applicable laws and regulations.
4. Device Data Integration
The App may connect to inewme-branded devices (e.g., hydration devices) via Bluetooth for the purpose of synchronizing data (such as device status, usage history, or skin condition analysis results). Such data is processed solely to enable App functionality and improve user experience.
These App Terms of Service govern only the use of the inewme App. The manufacture, safety, and performance of inewme devices are subject to the separate hardware warranty, instructions, and terms of use provided with each device.
5. Health Disclaimer
- The skin condition analysis and skincare recommendations are for wellness and informational purposes only.
- Our Services do not provide medical advice, diagnosis, or treatment.
- You should consult a qualified healthcare professional for medical concerns.
- Reliance on the App’s analysis or recommendations is at your own discretion and risk.
6. Data and Cloud Backup
If enabled, photos captured for skin condition analysis may be uploaded and securely stored on our cloud servers.
If you disable cloud backup, new photos will no longer be uploaded until you re-enable the feature. Disabling cloud backup does not delete any photos already stored on our servers.
Previously uploaded photos remain stored unless you delete your account, in which case your personal data (including uploaded photos) will be permanently erased.
7. Intellectual Property
All content, trademarks, and software in the App remain the property of inewme or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services.
8. Service Availability and Termination
We may suspend or terminate your access if you violate these Terms or applicable laws. You may delete your account at any time via the App’s “Account & Security” section. We reserve the right to discontinue the Services at any time, with or without notice, where legally permissible.
9. Limitation of Liability
- Our Services are provided “as is” and “as available.”
- To the maximum extent permitted by law, we disclaim all warranties and limit liability for indirect, incidental, or consequential damages.
- We are not responsible for losses caused by reliance on hydration recommendations, skin condition analysis, or environmental notifications.
- To the extent permitted by law, our total liability shall not exceed the amount you paid (if any) for the App or device.
10. Changes to Terms
We may update these Terms from time to time. If changes are material, we will notify you via in-app notice or email.
11. Governing Law (Global)
Unless otherwise required by local law, these Terms of Service and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Taiwan (R.O.C.), without regard to its conflict of law provisions. The parties agree that the Taipei District Court, Taiwan (R.O.C.), shall have exclusive jurisdiction as the court of first instance for any dispute or claim arising out of or relating to these Terms.
12. Account Deletion
You have the right to request the deletion of your account and associated data at any time.
How to Delete Your Account:
- Open the inewme App and navigate to “Settings” > “Account & Security”.
- Select “Delete Account” and follow the on-screen instructions to confirm.
- Alternatively, you can request account deletion by emailing us at service@inewme.com with your registered email or phone number.
Data Retention & Deletion Policy:
- Upon account deletion, all your personal data, including profile information and uploaded skin analysis photos, will be permanently erased from our servers.
- This process is irreversible. Please ensure you have backed up any necessary information before proceeding.
- Some data may be retained for a limited period if required by law or for legitimate business purposes (e.g., fraud prevention), after which it will be deleted.
U.S. Addendum – Terms of Service
This Addendum applies to users residing in the United States.
1. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the State of Delaware, excluding conflict of law rules.
- Any dispute shall be resolved through binding arbitration under the Federal Arbitration Act.
- Class Action Waiver: You agree not to participate in class actions, collective actions, or representative proceedings.
2. California Residents – CCPA/CPRA Notice
- You have the right to know, delete, and correct personal data collected.
- We do not sell or share your personal information.
- Sensitive data (e.g., facial images, skin condition analysis results) is used only to provide core services.
- We honor Global Privacy Control (GPC) signals as opt-out requests.
3. Children’s Privacy – COPPA
- Our Services are not directed to children under 13, and we do not knowingly collect their personal data.
- If we inadvertently collect such data, we will promptly delete it.
- Parents/guardians may request access, correction, or deletion of a child’s data via service@inewme.com.
